Privacy Notice in Recruitment Processes of Érius - Têxteis, S.A.
Érius - Têxteis, S.A. is committed to ensuring the security and privacy of your personal data. This document is intended to provide candidates in the selection and recruitment processes of Érius - Têxteis, S.A. with information regarding the processing of personal data that concerns them, as well as the privacy and security practices adopted, with the goal of making known its commitment and respect for the rules related to privacy and the protection of personal data it collects and processes in compliance with data protection legislation.
1. Scope
This Privacy Notice applies exclusively to the collection and processing of personal data carried out by Érius - Têxteis, S.A. within the recruitment and selection process for hiring employees. The processing of data is necessary to carry out all the steps of the recruitment process, provided that the data subject wishes to apply for the recruitment.
It applies to all applications, whether spontaneous or in response to specific recruitment processes.
It also applies to applications submitted on paper when addressed to the Human Resources Department of Érius - Têxteis, S.A., responsible for recruitment processes.
It applies to any other personal data that the candidate may provide, by any means, to us or the entity designated to intervene in the recruitment and selection process.
Érius - Têxteis, S.A. may also collect information about the candidate from publicly accessible sources, public agencies, and contacts provided by the candidate, to complement and/or verify the information provided by the candidate in the recruitment and selection process.
2. Personal Data
Personal data refers to any information, of any nature and format, including sound and images, related to an identified or identifiable individual. An individual is considered identifiable if they can be identified, directly or indirectly, by reference to an identification number or to one or more specific elements of their physical, physiological, mental, economic, cultural, or social identity.
2.1. Identification of the Data Controller
Érius - Têxteis, S.A. is the entity responsible for the collection and processing of the Candidates' Personal Data, and in this regard, decides which data is collected, the means of processing, and the purposes for which the data is processed.
2.2. What data we collect
Name, Address, Phone and Email Contact, Work Experience, Educational Qualifications, Citizen Card Number, Tax Identification Number, Age, and other details in the application form to be filled out by the candidate. We may also collect personal data through third parties, such as specialized recruitment companies, references, previous employers, employment background checks, as permitted by law.
2.3. Purposes of the processing
The personal data in question will be processed for the purposes of selecting and recruiting the candidate and, if selected, for integration into the workforce of Érius - Têxteis, S.A. within the scope of an employment and/or internship relationship. If the candidate is not selected for the position they applied for, the personal data collected will be considered, with their consent, for future positions that may arise and match the candidate's profile.
2.4. Legal basis for processing according to Article 6 of the GDPR
- Processing necessary for the performance of a contract to which the data subject is a party or for pre-contractual measures at the request of the data subject;
- Consent of the data subject.
2.5. Retention period
The personal data mentioned above may be retained by Érius - Têxteis, S.A. for the time necessary to pursue the purposes mentioned above:
• For a maximum of one year from (i) the submission of the application through which the data was provided, in the case of a spontaneous application and the candidate not having participated in any recruitment process of Érius - Têxteis, S.A. during that period;
• For a maximum of five years from (ii) the end of the recruitment process in which the data collection occurred, if the candidate was not hired, so that they may be considered for other recruitment processes that may be created and match the candidate’s profile and skills;
• When based on consent, the data will be retained for a period of five years or until the moment the data subject withdraws their consent.
2.6. Who we share your data with
The personal data of candidates may be processed by other entities to whom Érius - Têxteis, S.A. has outsourced its processing, namely specialized recruitment companies and temporary staffing agencies, contracted to assess and select applications, conduct interviews, and verify qualifications or other candidate data.
2.7. Your rights
• The candidate has the right to request, in writing, from the Responsible for Human Resources, via contact rgpd@erius.pt or in person by filling out the Personal Data Subject Rights Exercise Form:
• Access, in the terms and conditions legally provided, to the personal data that concerns them and is subject to processing;
• The correction or updating of inaccurate or outdated personal data concerning them;
• The processing of incomplete personal data when they are shown to be incomplete;
• The erasure, in cases specifically provided for by law, of personal data concerning them;
• The restriction, when the conditions provided by law are verified, of the processing of personal data concerning them;
• Withdrawal of consent when data processing is based solely on consent;
• To object to the processing for reasons related to their particular situation, when the processing of data is based on the legitimate interest of the data controller or a third party;
• The candidate may also request more detailed information, including the purposes, legal bases, and retention periods, and may also file complaints about how their personal data is processed, without prejudice to their right to do so with the National Data Protection Commission (CNPD) – Address: Av. • Some data requested from the candidate in the recruitment process may be a mandatory requirement for evaluating applications for specific positions. If this is the case, Érius - Têxteis, S.A. will inform the candidate, explaining that if the data is not provided, the application cannot be processed;
• Receiving personal data that concerns them and that they have provided to a data controller, in a structured, commonly used, and machine-readable format, and transmitting that data to another data controller without hindrance;
• The data subject has the right not to be subject to any decision based solely on automated processing, including profiling, that produces legal effects concerning them or similarly significantly affects them.
3. Security:
Érius - Têxteis, S.A. has implemented technical, operational, and organizational security standards, through policies, procedures, and internal controls, aimed at protecting personal data from loss, misuse, alteration, or destruction. Only authorized personnel from Érius - Têxteis, S.A. and our third-party service providers have access to personal data, with the obligation to treat this information as confidential. Despite these precautions, we cannot guarantee that unauthorized persons will not access your personal data.
